There is false news circulating suggesting that white women will benefit from the BEE codes later this year.

These articles, which you will find via Google, are written by people who want to write, but can’t even read!

Either that, or they don’t know what to read.

There’s an amendment to the Employment Equity Act which is currently in Bill form that includes white women as previously disadvantaged. Not to be confused with the B-BBEE Codes, which do not include, and will not include, white women.

I also recently heard that the Codes will in future only include black people as “black” and exclude Indians, coloureds and asiatics. Also nonsense.

  1. Good morning,

Our business unfortunately does not qualify as an EME anymore. I believe we are now a QSE.

How do we go about obtaining a BEE Certificate? Do we have to be measured or is there an affidavit we can do to declare our status?

    1. Hi Nadine,
I am assuming that your industry is not in a sector with its own codes. If that is not the case, then sector codes are often more onorous than the generic codes.
In terms of the generic codes, you can only do an affidavit if 51% or more black owned. Otherwise it’s a verification by a SANAS accredited agent.

  2. what will be my B-BBEE procurement recognition level if the business has a white female as owner.

  3. Could you assist me with the new way forward in 2023 as the previous PPPFA has now been declared unlawful. We are finding that all the tender documents are now changing with the % and points and it no longer says black woman, it now says woman.
Would we change this on our BBBEE Affidavit or what is the way forward?

    1. Hi Verina,
Unfortunately, I don’t know the answer as I don’t deal with government procurement. However, we cannot change the B-BBEE Affidavit because that is defined by the DTI and it still says “% black female owned”. Changing that would invalidate the affidavit. Perhaps a secondary affidavit to the effect that the company is a % female owned?

    1. Hi Elmarie,

Directorship is irrelevant If there are no black shareholders and if you don’t fit into one of the sectors, you’ll be Level 4 EME. We can provide the affidavit/certificate. Call Mini 011 805 0030.
